(pl) Policja zatrzymała niezależnego reportera i postawiła mu zarzut napaści na policjanta!

16 maja w Warszawie, podczas rozmów polityków na szczycie Rady Europy, odbyła się demonstracja zorganizowana przez oddolne ruchy obywatelskie w Polsce. Demonstranci protestowali przeciwko hipokryzji polityków RE i dopuszczeniu do obrad państw, w których łamane są prawa człowieka (m.in. Rosji i Turcji) oraz przywódców państw odpowiedzialnych za wojnę w Iraku.

Po demonstracji doszło do przepychanek z policją. Wszystkie wydarzenia były na bieżąco relacjonowane przez Niezależne Media - INDYMEDIA POLSKA. Gdy protestujący rozchodzili się do domów, policja zaczęła legitymować i zatrzymywać wyselekcjonowane osoby (patrz m.in. film http://pl.indymedia.org/pl/2005/05/13815.shtml).

Zatrzymano 11 osób, w tym 3 członków Amnesty International, dziennikarkę współpracującą z Indymediami oraz reportera Indymediów, który nagrywał kamerą zachowanie policji w trakcie demonstracji. Reporter Indymediów - Grzegorz Prujszczyk miał na sobie pomarańczową kamizelkę z napisem PRESS i zajmował się relacjonowaniem i dokumentowaniem demonstracji; nie miał nic wspólnego z zamieszkami z policją. Policja postawiła mu zarzut czynnej napaści na policjanta i w trybie natychmiastowym, bo już 18 maja (dzisiaj) o godzinie 10 miał rozprawę. Nie wpuszczono na nią nikogo z rodziny ani z dziennikarzy. Sąd zadecydował o zastosowaniu wobec Grzegorza dozoru policyjnego do czasu kolejnej rozprawy. Grozi mu kara do 8 lat pozbawienia wolności. Pozostałym 10 osobom przedstawiono drobniejsze zarzuty, jak np. lżenie policjantów i zwolniono je ok. 20 godzin po zatrzymaniu.

Z relacji jednego z zatrzymanych dowiedzieliśmy się, że policja wielokrotnie przekraczała swoje uprawnienia. Zatrzymany Andrzej Dołecki twierdzi, że:

1. Policjanci dokonujący zatrzymania (jak i ci w samochodach w trakcie transportu na komisariat) odmówili podania nazwisk i numerów służbowych.
2. W trakcie przewożenia nas na komisariat jak i na miejscu naszą stronę padało wiele gróźb i obelżywych słów.
3. Przez wiele godzin od zatrzymania odmawiano nam posiłku i wody
4. W trakcie rozlicznych przeprowadzanych czynności stosowano bezzasadną przemoc(wykręcanie rąk, popychanie na metalowe elementy samochodów, ściany, szturchania i szarpanie, krzyki i groźby)
5. W trakcie sporządzania protokołów skutecznie i do upartego odmawiano nam prawa do jakiejkolwiek informacji
6. Zarzuty względem nas były na komisariacie fabrykowane. Młodym policjantom dyktował je "funkcjonariusz" starszy stażem, sugerując coraz to nowe ,,winy’’, dzięki którym zarzuty względem nas będą poważniejsze. ''

Mamy dowody bezsprzecznie potwierdzające niewinność Grzegorza Prujszczyka (zdjęcia, nagrania filmowe, relacje świadków), które możemy udostępnić wszystkim zainteresowanym dziennikarzom. Jesteśmy przekonani, że zatrzymanie reportera Indymediów jest związane z jego pracą reporterską w trakcie demonstracji. Jest to ewidentny przykład łamania wolności słowa i ograniczania niezależności mediów.

Prosimy o solidarność z dziennikarzem Indymediów, nagłośnienie tej sprawy na całym świecie oraz wysłanie apeli do polskich instytucji państwowych i prasy.

(en) Police detained an independent journalist and charged him with assaulting a police officer!

On Mon 16th May in Warsaw, during politicians' talks during the third summit of the Council of Europe, demonstrations organised by grassroots citizens' movements from around Poland. The demonstrators protested against the hypocrisy of Council of Europe politicians and the inclusion of states in which human rights are violated (e.g. Russia and Turkey) and whose leaders are responsible for the war in Iraq.

After the demonstration, a conflictual incident with the police occurred. The full events were reported live by Independent Media - INDYMEDIA POLAND. When protesters started leaving to go home, police started checking people's identities and detained a selected number of people (see the film at http://pl.indymedia.org/pl/2005/05/13815.shtml).

11 people were detained, including 3 members of Amnesty International, a woman journalist working together with Indymedia as well as an Indymedia reporter, who was filming the police behaviour during the demonstration with a film camera. The Indymedia reporter - Grzegorz Prujszczyk - was wearing a reflective orange vest with the word PRESS and was reporting and documenting the demonstration; he was in no way involved in the conflictual incident which had occurred earlier with the police. The police have filed against him summary charges of assaulting a police officer; the first court hearing occurred Wed 18th May (today). Neither family nor journalists were given access to him. The court decided to commit Grzegorz to (partial) police custody until the next hearing. He is threatened with a penalty with a maximum sentence of 8 years' imprisonment. Lesser charges were placed against 10 other people, for example, insulting police officers, and they were freed after about 20 hours of detention.

From the account of one of the detainees, we found out that the police several times transgressed their rights. Ex-detainee Andrzej Dołecki claims that:

1. Police surveying the detainees (as well as those in the police vans transporting detainees to the police station) refused to give their names and service numbers.
2. During transport to the police station as well as at the police station, the police made threats against us and made insulting comments.
3. For many hours after the detention began, we were denied food and water.
4. In several incidents, unjustified violent actions were used against us (arm twisting, pushing us against metallic parts of the vans, walls, rough pushing and pulling, shouts and threats).
5. During preparation of paperwork, our right to have any information at all was vigorously and emphatically refused.
6. Trumped-up charges against us were prepared at the police station. A senior "official" dictated to younger policemen, successively suggesting new "faults", resulting in heavier charges against us.

We have indisputable evidence of Grzegorz Prujszczyk's innocence (photos, film recordings, witness statements), which we can provide to any interested journalists. We are convinced that the detention of this Indymedia reporter is because of his journalist work carried out during the demonstration. This is an obvious violation of freedom of speech and a constraint against independence of the media.

We would like to appeal for solidarity for this Indymedia journalist, for publication of this information around the world as well as for appeals to Polish governmental institutions and media.

(fr) La police a détenu un journaliste indépendant et l'a fait inculper pour violence à agent public

Le lundi 16 mai à Varsovie, pendant les discussions des hommes politiques au troisième sommet du Conseil de l'Europe, des manifestations ont été organisées par des mouvements citoyens polonais. Les manifestant-e-s ont protesté contre l'hypocrisise des politiciens du Conseil de l'Europe et l'inclusion des états dans lequels les droits humains sont violés (ex. la Russie et la Turquie) et dont les dirigeants sont responsables de la guerre en Iraq.

Après la manifestation, un incident conflictuel s'est passé avec la police. Tous ces événements ont été relationnés en direct par le Média Indépendant - INDYMEDIA POLOGNE. Lorsque les manifestant-e-s ont commencé de rentrer chez eux, la police a commencé de faire des contrôles d'identité et a détenu un certain nombre de personnes (voir le film à http://pl.indymedia.org/pl/2005/05/13815.shtml).

Onze (11) personnes ont été détenu-e-s, dont trois membres d'Amnesty International, une journaliste travaillant avec Indymédia ainsi qu'un journaliste Indymédia, qui filmait le comportement de forces de l'ordre pendant la manifestation avec une caméra. Le journaliste d'Indymédia - Grzegorz Prujszczyk - était habillé en veste orange hautement réflétante étiquetté avec un grand mot PRESS et relationnait et filmait la manifestation; il n'était en aucune façon impliqué dans l'incident conflictuel qui s'était passé plus tôt. La police lui a accusé de violence à agent public; il a été inculpé formellement le mercredi 18 mai (aujourd'hui). Ni sa famille ni des journalistes avaient pu communiquer avec lui. Le tribunal a décidé de mettre Grzegorz sous contrôle de la justice (avec liberté limitée) jusqu'à la prochaine séance au tribunal. Il risque une peine jusqu'au maximum de huit ans de prison ferme. Des accusations ont été faites contre dix autres personnes, par exemple, pour insulte verbal, et ils et elles ont été libéré-e-s après 20 heures de détention environ.

D'après le témoignage d'un des détenus, il s'est avéré que la police a plusieurs fois violé la loi. Andrzej Dolecki, qui avait été détenu, prétend que :

1. Les policiers gardant les détenu-e-s (ainsi que ceux dans les wagons les transportant vers le commissariat) ont refusé de donner leurs noms et leurs numéros de matriculation policière.
2. Pendant le voyage au commissariat ainsi qu'au commissariat, les fonctionnaires ont fait des menaces et nous ont insultés.
3. Pendant plusieurs heures de détention, on a refusé de nous ravitailler ou de nous donner de l'eau à boire.
4. Dans plusieurs incidents, des violences non-justifiées ont été utilisées contre nous (tordant le bras, nous poussant vers des parties métalliques des wagons, des murs, des bousculements, des cris et des menaces).
5. Pendant la préparation des documents, notre droit à être informé a été entièrement et vigoureusement refusé.
6. Des accusations fabriquées de toutes pièces ont été préparées au commissariat. Un fonctionnaire plus âgé a dicté aux policiers plus jeunes, suggérant de suite des « fautes » nouvelles, alourdissant successivements des accusations.

Nous avons des preuves solides de l'innocence de Grzegorz Prujszczyk (des photos, des enregistrements de films, des témoignages), que nous pourrions fournir aux journalistes qui en font la demande. Nous sommes convaincu-e-s que la détention de ce journaliste d'Indymédia a été faite uniquement parce qu'il a fait un travail de journaliste pendant la manifestation. C'est une violation évidente de la liberté d'expression et une contrainte contre l'indépendance des médias.

Nous appelons à la solidarité pour ce journaliste d'Indymédia, à la publication de ces informations autour du monde, et ainsi nous serions reconnaissant-e-s si vous pouviez contacter les autorités et médias polonais.
